• Assess grant eligibility based on provided organizational information
• Generate AI-assisted grant application content and materials
• Track and manage grant applications and deadlines
• Access cyber security resources and self-assessment tools

4.2 Service Limitations

You acknowledge and agree that:

• Grant Information: We aggregate grant information from public sources but do not guarantee the accuracy, completeness, or currency of grant listings. Always verify grant details with the funding organization.
• AI-Generated Content: AI-generated application content is provided as a starting point and must be reviewed, edited, and verified by you before submission. We do not guarantee that AI-generated content will meet specific grant requirements or result in successful applications.
• Eligibility Assessments: Eligibility scores and assessments are automated estimates based on information you provide. Final eligibility determination is made solely by the grant-making organization.
• No Guarantee of Funding: Use of our Service does not guarantee that you will receive grants, funding, or favorable outcomes. Grant decisions are made entirely by funding organizations.
• Third-Party Links: The Service may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites.
• Service Availability: We strive to maintain continuous service availability but do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance, updates, or other reasons.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to software, text, displays, images, video, audio, design, and the selection and arrangement thereof) are owned by Kantara and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms permit you to use the Service for your charitable organization's internal purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as permitted by these Terms.

5.2 Your Content

You retain all rights to the content you create, upload, or submit through the Service (“Your Content”). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing and improving the Service.

You represent and warrant that: (a) you own or control all rights to Your Content, (b) Your Content is accurate, (c) Your Content does not violate these Terms, and (d) Your Content will not cause injury to any person.

5.3 AI-Generated Content Ownership

Content generated by our AI tools based on your inputs becomes your property upon generation. However, you acknowledge that similar content may be generated for other users based on similar inputs, and we make no guarantee of uniqueness or exclusivity.

7.1 Subscription Tiers

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us at admin@kantara.org.uk or through your account settings. Upon termination, your right to use the Service will immediately cease.

10.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10.3 Effect of Termination

Upon termination:

• All rights granted to you under these Terms will immediately cease
• You must immediately cease all use of the Service
• We may delete your account data in accordance with our data retention policies
• You will remain liable for all obligations accrued prior to termination
• Sections that by their nature should survive termination shall survive, including provisions regarding ownership, warranties, disclaimers, indemnification, and limitations of liability

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

11.2 Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at admin@kantara.org.uk.

11.3 Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in England and Wales, and you irrevocably consent to the personal jurisdiction and venue therein.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect through:

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
